NOTICE OF PUBLIC HEARING REGARDING HOMELAND TOWERS, LLC (60 JANSEN ROAD), INCLUDING THE DRAFT ENVIRONMENTAL IMPACT STATEMENT, SITE PLAN, SPECIAL USE PERMIT, AND WETLAND AND WATERCOURSE PROTECTION PERMIT 

This notice was prepared in accordance with Article 8 of the Environmental Conservation Law.  

A public hearing to consider the Draft Environmental Impact Statement (“DEIS”) and site plan, special permit, and Town Wetland and Watercourse Protection Permit application of Homeland Towers, LLC will be held by the Town of New Paltz Planning Board on April 5, 2021 at 7:00 P.M., or as soon thereafter as the matter can be heard, via videoconference, provided the Governor’s Executive Order 202.1 allowing public meetings to be held remotely by conference call or similar service is extended prior to April 5, 2021. The Applicant, Homeland Towers, LLC, is proposing to construct a major wireless telecommunications commercial cellular tower structure, consisting of a 150-foot monopole, a fenced in equipment compound, and a 12-foot wide, 900-foot long gravel access road with a turnaround area. The application requires a use variance, special permit, site plan approval, and a Town Wetland and Watercourse Protection Permit, on a property having frontage along Jansen Road within the Town of New Paltz. The property contains 44.7+/- acres, and is known on the Town tax maps as Section 86.8, Block 2, Lot 16. The property is located within the Town’s R-1 zoning district. The application and supporting documents are available on the Town website for viewing by the public. At 7:00 PM, or as soon thereafter as the matter can be heard, the Public Hearing will be opened and the Planning Board will accept comments from all interested members of the public. The Public Hearing may be closed or continued at the Planning Board’s discretion. 

The Proposed Action has been classified as a Type I action under the State Environmental Quality Review Act (“SEQRA”), and a Positive Declaration was issued by the Planning Board on September 30, 2020.  

The purpose of the public hearing is to provide an opportunity for public input on the DEIS and the proposed site plan, special permit and s Town Wetland and Watercourse Protection Permit application.  The DEIS is available on the Town of New Paltz website (https://www.townofnewpaltz.org/planning-board/pages/current-projects-under-review) and full copies of the DEIS are available at the Town Building Department located in Town Hall (52 Clearwater Road, New Paltz, NY) by appointment (e-mail to planzoneboard@townofnewpaltz.org to arrange an appointment) as well as at the Elting Memorial Library (93 Main Street, New Paltz, NY).  

Owing to the novel COVID-19 pandemic, as well as federal, State, and County declarations of emergency, and in accordance with Executive Order 202.1 issued by New York State Governor Andrew Cuomo on March 12, 2020 suspending the New York State Open Meetings Law (Article 7 of the Public Officers Law) to the extent necessary to permit public bodies to meet and take actions without permitting in public in-person access to meetings and authorizing such meetings to be held remotely by conference call or similar service, physical attendance by the public at the hearing will not be permitted. The public may attend or view the hearing via Zoom or YouTube as set forth above and a recording of the meeting will subsequently be made available on the Town’s YouTube channel. In the event the Governor’s Executive Order 202.1 allowing public meetings to be held remotely is not extended and expires prior to April 5, 2021, information about the meeting location and further instructions will be made available on the Town’s website (https://www.townofnewpaltz.org) prior to April 5, 2021. 

Comments may be made in person at the public hearing. Written comments will be received at any time during the comment period in the Town Building Department.  The comment period will extend for a minimum for 10 days following the closing of the public hearing.
