FOR THE PURPOSE OF CONSIDERING THE FOLLOWING 

APPLICATION OF ZB21-28: Trans-Hudson Management Corp. for (3) AREA VARIANCES at 12 N. Putt Corners Road. The applicant requests relief from (1) §140.22.2(C)(7)(a), which requires a minimum of two occupiable stories as an “Area and Bulk Regulation;” (2) and (3) §140.22.2(D)(3)(a) and §140.22.2(D)(3)(c), which requires buildings have at least two occupiable stories and prohibits the use of drive-through windows for food and beverage service use respectively, as “Design Standards.” The application and supporting documents are available on the Town website for viewing by the public. At 7:00 PM, or as soon thereafter as the matter can be heard, the Public Hearing will be opened and the Zoning Board of Appeals will accept comments from all interested members of the public. The Public Hearing may be closed or continued at the Zoning Board’s discretion. 

Owing to the novel COVID-19 pandemic, as well as federal, State, and County declarations of emergency, and in accordance with Executive Order 202.1 issued by New York State Governor Andrew Cuomo on March 12, 2020 suspending the New York State Open Meetings Law (Article 7 of the Public Officers Law) to the extent necessary to permit public bodies to meet and take actions without permitting in public in-person access to meetings and authorizing such meetings to be held remotely by conference call or similar service, physical attendance by the public at the hearing will not be permitted. The public may view the hearing via YouTube as set forth above and a recording of the meeting will subsequently be made available on the Town’s YouTube channel. Public comments can be made during the hearing or e-mailed to planzoneboard@townofnewpaltz.org by 12 PM on March 10, 2021. 

ALL PARTIES FOR OR AGAINST SAID SUBJECT WILL BE GIVEN AN OPPORTUNITY TO BE HEARD IN RESPECT TO THIS APPLICATION.
